wawa biik (a registered business of Taungurung Land and Waters Council) is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information. Wawa biik operates scheduled and private cultural experiences on Country, led by Taungurung guides and owns and operates the wawa biik website (www.wawabiik.com.au) (the “Website”) to provide information relating to these experiences.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

Please ensure that you read this Privacy Policy (“Privacy Policy”) carefully as it applies to all personal information collected by us in relation to your interaction with wawa biik.

Acceptance of this Privacy Policy

By accessing and/or using our Website to book cultural experiences, you indicate your acceptance to be bound by this Privacy Policy and the Standard Booking Conditions (“Terms”) (see our Website for more details) and agree that you have had sufficient opportunity to read and understand them.

By providing personal information to us, you consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy. If you do not agree to this Privacy Policy, you should inform us and immediately cease using our Website.

What is Personal Information and why do we collect it?

Personal Information is information that identifies an individual. Examples of Personal Information we collect include:
  • your full name, title, address, email address, phone number; date of birth, next of kin, dietary requirements, medical requirements
  • Your IP address, web log and related domain, browser, computer and connection information, time zone, device ID, device type, geo-location information, and some of the cookies that are installed on your device
  • we may also ask for medical / health information, such as pre-existing medical conditions, vaccination status, if you have a disability, medication that requires refrigeration, food allergies etc., some of which is considered sensitive information or special category data under relevant data protection laws;
  • any additional information you provide during the booking process to check if an experience is right for you, which may include personal information.

We also process and store records of the products and services you have enquired about or purchased from us, as well as collect and process information relevant to your booking (such as accommodation details) that you have not booked through wawa biik, where this information has been passed to us by our partners and/or third parties.

How do we collect your personal information?

This Personal Information is obtained in person with our staff, or via telephone or by email or our website booking platform on www.wawabiik.com.au.

You may volunteer this information when you request information from us, contact us (and vice versa), make a booking, register interest for and/or enter a competition, subscribe to one of our marketing/mailing list(s), use our website, link to or from our website, connect with us via social media, by speaking to a consultant or any other engagement we or our business partners have with you.

We may also receive the information from a third party, for example:
  • from people making travel bookings on your behalf;
  • from market research and data companies contracted by us to obtain information so that we may improve and market our products and services
  • from other companies related to wawa biik
  • from partners performing services we work with and who may perform services on our behalf, and
  • your insurer, their agents or medical staff may disclose relevant information and sensitive personal information with us in circumstances where we/they need to act on your behalf or in the interest of passengers or in an emergency.

We will update your information whenever we can to keep it current, accurate and complete.

You represent and warrant to us that you have obtained all required consents and are fully authorised to disclose all personal information you provide to us including without limitation personal information of your friends and family members provided in connection with making travel bookings.

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information (excluding health information) will not be collected by us.

Other than where it is in your vital interests or required by relevant laws, medical/health information can only be used by wawa biik with your consent. This is because medical/health information is considered sensitive and by consenting, you are showing us that you understand and agree to us collecting this information. Providing medical/health information and consenting to its use by wawa biik is optional, however, it is highly recommended that information be provided (including if requested) for your safety and wellbeing.

Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

However, we are not responsible for the privacy practices of third party suppliers, including payment providers, so you should review any privacy policy of third party vendor or providers to satisfy yourself as to how they protect and handle your personal information.

Photos and Video

When you are travelling with us on a cultural experience, as part of your experience a photo or video may be taken either by the Cultural Tour Guide, an employee of Wawa Biik or one of our partners or another passenger. We care about your privacy so if you do not wish for your photograph to be taken at any time, or to be included in any video, please let your Cultural Tour Guide or the photographer know. Any photos taken by Wawa Biik staff (including employees and Cultural Tour Guides) will not be used for marketing purposes without your prior knowledge. Whilst we take every precaution to protect your privacy, we are not responsible for passengers who may take your photograph or video you without our knowledge.

On some occasions, we may engage professional photographers to take and obtain photos to use in our marketing materials. We ensure that all of our customers are notified prior to travelling on our trips if a professional photographer is being engaged and you have the right to say no or opt-out of being included in any photos being taken for these purposes, including any subsequent content or images use.

Why do we collect, use, hold and disclose of your information?

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our third party partners and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Disclosure of Personal Information

Your Personal Information may be disclosed in a number of circumstances including the following:
  • Third party partners in the course of providing our services;
  • Other third parties where you consent to the use or disclosure; and
  • Where required or authorised by law.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

Access to your Personal Information

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

wawa biik will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information

It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

As a Taungurung Elder who has worked for his mob for two decades doing cultural surveys, Uncle Shane could probably write a book about what he’s seen and experienced out there in the field.   Protecting cultural heritage is core to the work of any Custodians of Country and is a responsibility that is directly overseen by Elders.
